Who are they?

National Action Financial Services, a.k.a. NAFS, is a debt collection agency based out of Williamsville, New York that was established in 1995 as a national collection company for credit card issuers, banks, auto lenders and debt buyers. Among other things, NAFS’s website boasts that 100% of their collection calls are recorded (both inbound and outbound), that they maintain on-site call monitoring, and that they regularly re-test employees on the requirements and prohibitions of the FDCPA.

Are they legitimate?

A review of various consumer complaint forums on the internet suggests that NAFS occasionally engages in abusive, deceptive and unfair debt collection practices.

To be sure, New York’s Attorney General sued the collections agency in 2007 because it was felt that “this company’s alleged tactics went far beyond legal – or even normal – methods of debt collection.” More specifically, NAFS was the subject of approximately 90 complaints from across the country to the Attorney General’s Office over the three years immediately preceding the suit. According to many of the complaints raised, NAFS continuously called third parties for location information despite requests to stop, falsely claimed that they were calling from an attorney’s office, falsely claimed that NAFS (or a creditor) was about to commence legal action, discussed debts with third parties, and/or continued to call debtors despite requests to stop.

One complaint in particular told the story of a consumer who felt harassed because NAFS proceeded to send a fax to her place of employment 20 times within 2 ½ hours. To its credit, upon being approached by the Attorney General’s Office, NAFS conducted its own internal inquiry and fired the collector. That being said, claims on the web by disgruntled consumers suggest that the agency has not done away with all of its unlawful collection efforts.
